1. Parties
This Residential Subscription Agreement (the "Agreement") is entered into as of the Effective Date between:

The Customer's name, contact information and service address are held in the Nafas account profile. The Customer is responsible for keeping this information accurate and current via the Nafas app (Account → Profile Settings).
2. Formation of Agreement
2.1 This Agreement is formed when the Customer completes the subscription sign-up in the Nafas app and ticks the acceptance checkbox confirming they have read, understood and agreed to these terms.
2.2 Digital acceptance through the Nafas app is legally binding and has the same legal force as a handwritten signature under the laws of Indonesia. Acceptance records are stored by Nafas with a timestamp and are available to the Customer on written request.
2.3 Immediately upon acceptance, a copy of this Agreement and the Subscription Order are sent automatically to the Customer's registered email address.
2.4 The Customer may access this Agreement at any time via the Nafas app under Account → My Subscription → Agreement.
3. Definitions
In this Agreement, unless the context otherwise requires:

4. Scope of Service
4.1 Included in the Subscription
- Provision of indoor air quality monitoring, data and analytics through the Nafas mobile application.
- Loan and deployment of the Equipment specified in the Subscription Order at the Customer Premises.
- Standard installation and commissioning by a Nafas-authorised technician.
- Preventive maintenance visits approximately every two (2) months.
- Filter replacement approximately every six (6) to nine (9) months, up to two (2) replacements per Subscription Year.
- Remote system monitoring, performance optimisation and customer support via WhatsApp, email and the in-app help centre.
- Warranty coverage for normal operation and manufacturing defects as set out in Clause 8.
4.2 Excluded from the Subscription
- Damage caused by misuse, negligence, abuse, vandalism or external factors beyond reasonable wear and tear.
- Use of non-original or non-Nafas-supplied filters or accessories.
- Unauthorised repairs, modifications, dismantling or relocation of the Equipment.
- Damage caused by unstable electrical supply, power surges or wiring faults at the Customer Premises.
- Physical damage including drops, impact, pet damage or liquid exposure.
- Costs associated with building access, lift booking, parking permits or third-party charges at the Customer's residence.
5. Equipment, Ownership and Damage
5.1 All Equipment is loaned to the Customer for the Term and remains at all times the sole and exclusive property of Nafas. The specific Equipment assigned is confirmed in the Subscription Order and the installation confirmation email.
5.2 The Customer shall not sell, lease, pledge, modify, disassemble, reverse-engineer or affix any markings to the Equipment.
5.3 The Customer shall keep the Equipment in good condition and shall not move it from the installation location without prior written consent from Nafas.
5.4 The Customer is responsible for the safekeeping of the Equipment. The Customer shall be liable for any loss, theft or damage beyond reasonable wear and tear. Nafas shall assess the condition of any returned or retrieved Equipment and shall notify the Customer of any applicable Damage Fee by email within fourteen (14) days of collection.
5.5 Damage Fees are calculated by reference to the replacement cost schedule communicated by Nafas in writing from time to time. Damage Fees are invoiced to the Customer and sent to the registered email address, due within fourteen (14) days of invoice.
5.6 Upon expiry or termination of this Agreement, the Customer shall make the Equipment available for collection by Nafas in working condition (excluding consumable filters) within fourteen (14) calendar days. A collection confirmation will be sent to the Customer's registered email address.
6. Installation and Site Conditions
6.1 Nafas shall install the Equipment within the timeframe communicated by email and in-app notification following payment of the first invoice.
6.2 The Customer shall provide: (a) safe and clear access to the installation location; (b) a stable 2.4 GHz Wi-Fi network; (c) a standard mains power outlet within 1.5 metres of each device; and (d) any required building management or landlord approvals.
6.3 A technician preparation guide will be sent to the Customer's registered email address at least forty-eight (48) hours before the scheduled visit.
6.4 An installation confirmation email listing the installed devices, serial numbers and locations will be sent to the Customer's registered email address upon completion of installation. This email forms part of the Equipment record under Annex A.
7. Maintenance and Filter Replacement
7.1 Nafas shall provide preventive maintenance visits approximately every two (2) months and filter replacement approximately every six (6) to nine (9) months. Service levels are set out in Annex B.
7.2 Maintenance visits are coordinated through the Nafas application or WhatsApp. Visit confirmation and post-visit summaries are sent to the Customer's registered email address.
7.3 If the Customer fails to attend or reschedule three (3) consecutive scheduled maintenance visits without reasonable cause, Nafas may suspend the Service and apply a revisit fee, with prior written notice by email.
8. Warranty and Replacement
8.1 Nafas warrants that under normal residential operating conditions the Equipment will be free from manufacturing defects and perform to its published specifications throughout the Subscription Period.
8.2 Warranty covers: (a) manufacturing defects; (b) functional failure under standard residential use; and (c) performance degradation not attributable to Customer misuse.
8.3 Warranty does not cover the events listed in Clause 4.2 and terminates immediately upon termination of this Agreement or suspension of the Service for non-payment exceeding thirty (30) days.
8.4 Replacement requests must be raised via the Nafas app (Help → Request Maintenance) or WhatsApp. Nafas shall replace, repair or provide a substitute unit in accordance with the SLA in Annex B.
9. Service Coverage Area
Nafas currently provides the Service in Indonesia. The Customer Premises must be located within the Service Coverage Area for the duration of the Subscription Period. If the Customer relocates outside the Service Coverage Area, the Customer shall notify Nafas at least thirty (30) days in advance via the Nafas app or by email to [email protected].
10. Term and Renewal
10.1 This Agreement commences on the Effective Date and continues for an Initial Term of twelve (12) months.
10.2 The Agreement automatically renews for successive Renewal Terms of twelve (12) months unless either Party gives written notice of non-renewal at least thirty (30) days before the end of the then-current Term. The Customer may manage renewal settings in the Nafas app under Account → My Subscription.
10.3 Nafas may adjust Fees for any Renewal Term by giving at least thirty (30) days' prior written notice by email and in-app notification.
11. Fees, Payment and Late Payment
11.1 The Customer shall pay the monthly subscription Fees in IDR (Indonesian Rupiah) as confirmed in the Subscription Order. Applicable taxes are as set out in the Subscription Order. The current Fee is accessible at all times via the Nafas app under Account → My Subscription → Plan & Pricing.
11.2 Payments are processed via Xendit (operated by PT Aria Teknologi Bersih). Equipment is dispatched from the PT Aria Teknologi Bersih warehouse in Indonesia. All payment, billing and gateway details are confirmed in the Subscription Order. Invoices and payment receipts are sent to the Customer's registered email address after each billing event and are accessible in the Nafas app under Account → Billing History.
11.3 If a payment is not received by the due date: (a) Nafas will retry the charge automatically; (b) reminder notifications will be sent by email and in-app at twenty-four (24), forty-eight (48) and seventy-two (72) hours after the due date; and (c) the Service will be suspended after seventy-two (72) hours of non-payment, with written notice to the Customer's registered email address.
11.4 If the outstanding Fee remains unpaid for thirty (30) or more calendar days following the original due date, Nafas shall be entitled to: (a) terminate this Agreement with immediate effect by written notice to the Customer's registered email address; (b) retrieve the Equipment from the Customer Premises; and (c) charge the Customer for all outstanding Fees, late-payment interest at the maximum rate permitted under applicable law, and any Damage Fee assessed upon retrieval. The Customer shall cooperate with and provide reasonable access for Equipment retrieval.
11.5 Before initiating retrieval under Clause 11.4, Nafas will send a written retrieval notice to the Customer's registered email address giving a minimum of seven (7) days' advance notice, except where the Customer has refused access or rendered notice impracticable.
12. Pause Policy
12.1 The Customer may pause the Service up to two (2) times per Subscription Year for a maximum aggregate duration of three (3) months per Subscription Year.
12.2 No pause may be taken within the first three (3) months of the Initial Term.
12.3 During a pause period Equipment remains installed at the Customer Premises, a reduced fee applies as set out in the Subscription Order, and preventive maintenance visits are deferred until the Service resumes.
12.4 Pause requests must be submitted via the Nafas app or by email to [email protected] at least seven (7) calendar days before the requested pause start date.
13. Cancellation and Termination
13.1 The Customer may terminate this Agreement at any time by giving Nafas at least fourteen (14) working days' written notice via the Nafas app (Account → My Subscription → Cancel Subscription) or by email to [email protected].
13.2 If the Customer terminates during the Initial Term or a Renewal Term other than for material breach by Nafas, an early-termination charge equal to fifty percent (50%) of the remaining contracted Fees for the current Term shall apply, together with all outstanding Fees.
13.3 Either Party may terminate with immediate effect by written notice if the other Party: (a) commits a material breach not remedied within fourteen (14) days of written notice; (b) becomes insolvent; or (c) is required by law to do so.
13.4 Nafas may also terminate under Clause 11.4 in the event of non-payment as set out therein.
13.5 Upon termination: (a) the Customer shall cease all use of the Equipment; (b) make the Equipment available for collection within fourteen (14) calendar days; and (c) pay all outstanding Fees, early-termination charges and Damage Fees within fourteen (14) days. A final invoice will be sent to the Customer's registered email address.
14. Refunds
14.1 Prepaid Fees beyond the termination date will be refunded on a pro-rata daily basis, less outstanding Fees, the early-termination charge and any Damage Fees.
14.2 Refunds will be processed within fourteen (14) working days to the original payment method. A refund confirmation email will be sent to the Customer's registered email address.
15. Customer Obligations
- Use the Equipment solely for personal, non-commercial residential use at the Customer Premises.
- Use only original Nafas-supplied filters and accessories.
- Provide a stable mains power supply and 2.4 GHz Wi-Fi connection at the installation location.
- Permit Nafas-authorised technicians reasonable access for installation, maintenance and collection visits with at least forty-eight (48) hours' prior notice, except in emergencies.
- Notify Nafas promptly of any malfunction, damage, loss or theft of Equipment via the Nafas app or email.
- Pay all Fees in accordance with the Subscription Order.
- Maintain accurate contact information and a current payment method in the Nafas app account.
- Cooperate with Equipment retrieval in the event of termination or non-payment and provide access within a reasonable timeframe.
16. Liability and Indemnity
16.1 Nothing in this Agreement excludes liability for: (a) death or personal injury caused by negligence; (b) fraud; or (c) any liability that cannot be excluded by applicable law.
16.2 Subject to Clause 16.1, Nafas's total aggregate liability shall not exceed the total Fees paid by the Customer in the twelve (12) months immediately preceding the event giving rise to the claim.
16.3 Nafas shall not be liable for indirect, special or consequential loss, loss of profits, or loss or corruption of data.
16.4 Nafas does not provide medical advice. The Service supports indoor air quality but does not guarantee any specific health outcome.
16.5 The Customer shall indemnify Nafas against third-party claims arising from the Customer's breach of this Agreement, including Clauses 5 and 15.
17. Force Majeure
Neither Party shall be liable for any failure or delay caused by events beyond its reasonable control, including acts of God, war, terrorism, fire, flood, pandemic or government action. If a force majeure event continues for more than sixty (60) days, either Party may terminate without penalty on written notice.
18. Personal Data Protection
18.1 Nafas processes personal data in accordance with Law No. 27 of 2022 on Personal Data Protection (UU PDP) and its implementing regulations and its Privacy Notice available at https://nafas.com/policy and in the Nafas app.
18.2 Personal data processed includes: name, contact details, billing information, installation address, device identifiers, indoor air quality readings and customer support communications.
18.3 The Customer may exercise rights of access, rectification, deletion, restriction and objection by contacting Nafas via the app (Account → Privacy) or by email to [email protected].
19. Confidentiality
Each Party shall keep confidential any non-public information of the other Party and shall not disclose it to any third party except as required by law or to professional advisers under equivalent obligations of confidence. This clause survives termination for two (2) years.
20. Intellectual Property
All intellectual property rights in the Equipment, the Nafas application and the Service are and shall remain the exclusive property of Nafas or its licensors. The Customer is granted a personal, non-transferable, non-exclusive licence to use the Nafas application solely for the purpose of receiving the Service during the Subscription Period.
21. Consumer Rights
The Customer is entitled under Law No. 8 of 1999 on Consumer Protection (UUPK) and its implementing regulations to accurate information about the Service, to fair contract terms, and to compensation for harm. Nothing in this Agreement excludes any non-waivable consumer right. The Customer may file a complaint with the Consumer Dispute Settlement Agency (BPSK) or the Ministry of Trade.
22. Governing Law and Dispute Resolution
22.1 This Agreement is governed by and construed in accordance with the laws of the Republic of Indonesia.
22.2 The Parties shall first attempt to resolve any dispute amicably through good-faith negotiation within thirty (30) days of written notice.
22.3 Any dispute not resolved through negotiation shall be submitted to the exclusive jurisdiction of the competent District Court (Pengadilan Negeri) in Jakarta, or the Indonesian National Arbitration Board (BANI) at the election of the Parties.
23. Notices
All notices, invoices, receipts and communications under this Agreement shall be delivered to the Customer's registered email address as recorded in their Nafas app account, and to Nafas at email: [email protected]. Email notices are deemed received on the next business day after sending. The Customer is responsible for keeping their registered email address current in the Nafas app.
24. General Provisions
24.1 Assignment. The Customer may not assign this Agreement without Nafas's prior written consent. Nafas may assign to an affiliate or successor with notice to the Customer.
24.2 Variation. Nafas may update these terms with at least thirty (30) days' notice by email and in-app notification. Continued use of the Service after the notice period constitutes acceptance.
24.3 Severability. If any provision is held invalid or unenforceable, the remaining provisions continue in full force.
24.4 Waiver. No failure or delay in exercising any right constitutes a waiver of that right.
24.5 Entire Agreement. This Agreement, together with the Subscription Order and Annexes, constitutes the entire agreement between the Parties and supersedes all prior proposals and representations.
25. Acceptance
This Agreement is accepted digitally through the Nafas mobile application. By completing the subscription sign-up process and ticking the acceptance checkbox in the Nafas app, the Customer confirms that they have read, understood and agree to be bound by the terms of this Agreement and its Annexes. No handwritten or wet signature is required or requested.
Acceptance is recorded electronically in the Nafas system with the Customer's account email, timestamp and subscription reference number, and a copy is sent immediately to the Customer's registered email address. This electronic record has full legal force under the laws of Indonesia.
This Agreement is authorised on behalf of PT Aria Teknologi Bersih by its duly authorised representative in accordance with its constitutional documents.
Annex A — Equipment
The specific devices, models, serial numbers and installation locations assigned to the Customer's subscription are recorded in the Customer's Nafas account and confirmed by email at the time of each installation or replacement visit.

The installation confirmation email sent to the Customer's registered email address upon completion of each installation or device replacement visit forms part of this Agreement as supplementary Equipment documentation.
